Davis case to be heard Jan. 23

The state's Second Court of Appeals in Fort Worth has scheduled the hearing on Wendy Davis' state Senate candidacy for Jan. 23. Davis is the Democratic candidate for the seat held by Republican Kim Brimer. The Fort Worth Firefighters Association is trying to have Davis taken off the ballot, saying her term as a Fort Worth City Council member ended after the primary filing deadline and state law prohibits a sitting council member from running for another office.

The firefighters asked the Supreme Court to hear the case, but the justices pushed the case back to the appellate court.
