Wendy's Ballot Battle, Part Deux?

Wendy Davis may not be out of the woods yet.

Brimer For those just tuning in, the Second Court of Appeals ruled last month that three firefighters who were challenging Davis' eligibility to run for the state Senate didn't have legal standing.

According to the three-judge panel, only a political opponent has legal standing. Since Davis doesn't have any primary opponents, that leaves Republican state Sen. Kim Brimer of Fort Worth, the incumbent Davis is trying to unseat.

So will Brimer sue Davis? We asked him last night at the David Dewhurst reception at the Fort Worth Botanic Garden. Apparently, he's still waiting to see whether the firefighters appeal the decision to the Texas Supreme Court.

"The firefighters have to decide what they're going to do," Brimer said. "They're the ones that have the action going, and I'm going to respect what they're doing at this time."

We asked again, but Brimer wouldn't say whether he was even considering formally challenging Davis' eligibility.
